1The short version
This summary is not the agreement and does not replace the clauses below — but nothing below contradicts it.
- What you make is yours. foldnote gets only the permission it needs to store your notes and show them to the person you sent them to.
- One subscription covers both partners. Your partner is never asked to buy anything.
- Features that are free stay free. Your whole history is one of them, in writing, in clause 8.
- Apple takes the money and Apple handles refunds. Cancel any time in your iPhone’s Settings.
- You must be 17 or older.
2Who this agreement is with
These Terms are an agreement between you and set legalEntity in site.config.ts, the maker of foldnote for iOS (“the app”). Downloading, opening, or using the app means you accept them. If you do not, do not use the app.
The Privacy Policy forms part of these Terms.
3Who can use foldnote
The app is rated 17+ and you must be at least 17 years old to use it. It is designed for exactly two people in a relationship with each other. There is no group mode, no third member, and no public or social feed of any kind.
4Your account
An account is required, because two devices have to share the same state. You can create one with Sign in with Apple or with an email address. foldnote never asks for a phone number.
You are responsible for the security of the Apple ID or email account you sign in with, and for what happens under your account. Tell set contactEmail in site.config.ts promptly if you think someone else has access to it.
5Pairing, and the couple
One of you creates a couple and receives a six-character invite code, valid for seven days. The other person enters it, or opens the link that carries it. From then on you are a couple in the app: you share a day counter, a streak, a daily question, and an archive.
Content created inside a couple is visible to both of you. That is the entire point of the product, and it means you should only send things you are content for the other person to keep — a note that has been delivered is in their archive, exactly as a posted letter is in someone’s drawer. Section 10 of the Privacy Policy explains what happens to it if you later delete your account.
6Subscriptions and payment
The app is free to download and use. Premium is optional, and is sold as:

Prices are in US dollars and may differ in your territory; the price shown in the App Store at the moment of purchase is the price that applies.
- Payment is taken by Apple and charged to your Apple Account at confirmation of purchase.
- A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the end of that period.
- Cancel in Settings → your name → Subscriptions on your iPhone. Deleting the app does not cancel a subscription, and neither does deleting your foldnote account.
- Refunds are handled by Apple, under Apple’s own terms. foldnote cannot issue or refuse one. If a free trial is offered, any unused part of it is forfeited when a subscription is purchased.
7One subscription, two people
When one partner buys Premium, the other partner in the same couple receives the same Premium features for as long as that subscription is active. This is a term of this agreement, not a promotion, and it is not withdrawn from anyone who already has it.
Premium received this way ends when the paying partner’s subscription ends, or when the couple is unpaired. It cannot be transferred to a third person, and pairing exists to connect two partners rather than to distribute a subscription — sharing one code around to get free access is a misuse of the app under clause 10.
8What stays free
The following are free, and will not be moved behind a paywall for anyone, at any point, including people who already use them:
- The day counter, the streak, and the widget.
- Sending and receiving notes, drawings and photographs.
- One question a day, and the reveal.
- Milestones and their reminders.
- Access to everything you have ever made — every note, photograph, answer and milestone — whether or not you have ever paid, and after any subscription ends.
New paid features may be built, and existing free ones may be improved. Taking an existing free feature away and selling it back is the one thing this clause exists to prevent.
9Your content
You own everything you make in foldnote — notes, drawings, photographs, answers, milestones. Nothing here transfers ownership.
To operate the app, set legalEntity in site.config.ts needs a narrow permission from you: a non-exclusive, worldwide, royalty-free licence to store, copy, transmit and render your content solely in order to provide foldnote to you and to your partner — delivering a note, rendering it for the widget, keeping your archive, and backing it up. The licence exists only for that purpose and ends when the content is deleted.
Your content will not be published, used in marketing, sold, shared with anyone outside your couple, or used to train a machine-learning model. If a request is ever made to feature something you made, it will be a request, and no is a complete answer.
You are responsible for having the right to what you upload — a photograph of someone else, for instance.
10Acceptable use
Do not use foldnote to:
- harass, threaten, monitor or coerce another person, including the person you are paired with;
- upload content that is unlawful, or that you have no right to upload;
- upload sexual content involving anyone under 18, which will be reported to the relevant authorities;
- attack, probe or overload the service, or attempt to reach data belonging to any couple other than your own;
- circumvent payment, share invite codes to distribute Premium, or resell access.
An account may be suspended or closed for a serious or repeated breach. Where it is possible and lawful to do so, you will be told why and given a chance to export what you made.
11Availability and changes
foldnote is an app made by one person. It is offered as-is, without a guaranteed uptime, and features may be added, changed or removed as it develops — subject always to clause 8.
If the service is ever going to be discontinued, you will be given at least 60 days’ notice and a way to export your content before it stops.
12Ending the agreement
You can stop at any time: delete your account in More → Account → Delete account, and cancel any subscription with Apple. Deleting your account ends this agreement, other than the clauses that are meant to survive it — content licences that already ended, disclaimers, liability limits and governing law.
13Apple
Apple is not a party to this agreement and has no responsibility for foldnote or its contents. Apple has no obligation to provide any support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Any claim relating to your possession or use of the app is the responsibility of set legalEntity in site.config.ts, not Apple — including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation. Any third-party claim that the app infringes intellectual property rights is likewise handled by set legalEntity in site.config.ts.
You confirm you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms — for example your wireless carrier’s.
Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement and, on your acceptance of it, have the right to enforce it against you.
14Disclaimers
To the extent the law allows, foldnote is provided “as is” and “as available”, without warranties of any kind. It is a way for two people to send each other notes. It is not counselling, therapy, medical advice, or a substitute for any of those, and it is not a backup service — keep your own copies of photographs that matter to you.
Nothing in these Terms excludes or limits any right you have as a consumer that cannot lawfully be excluded or limited.
15Limitation of liability
To the extent the law allows, set legalEntity in site.config.ts is not liable for indirect or consequential loss, or for lost profits, revenue or data. Total liability arising out of or relating to foldnote is limited to the greater of the amount you paid in the twelve months before the claim arose, or US$50.
This clause does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
16Governing law
These Terms are governed by the law of set jurisdiction in site.config.ts, and its courts have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the protection of the mandatory laws of the country you live in and may bring proceedings there.
17Changes to these terms
These Terms may change as the app changes. If a change materially affects your rights, the app will tell you before it takes effect and the date at the top of this page will change. Continuing to use foldnote after that means you accept the new version; if you do not, delete your account and cancel any subscription.
